What documents do I need for the property sale?

Energy certificate, land register extracts, building plans - anyone who wants to sell an inherited property usually searches high and low for the necessary documents. If something is missing or documents have expired, you will have to go to the authorities. We have compiled the necessary documents and where you can find them so that you don't have to spend a lot of time searching.

Many people know that in order to sell a property, the Land register extract is required. It states who the owner is and whether the property is encumbered with debts or a mortgage. You can obtain the extract from the land register from the land registry.

Also the Parcel map is important. It is the official proof of the existence of a property. It shows its location and boundaries, the development and the parcel and plot number, which is used to identify the property. The land registry office is responsible for the cadastral map.

Equally necessary are the Building plans. This also includes the building permit certificate, a building description and, in the case of newer buildings, an acceptance certificate. You can obtain the complete set of building plans from the building regulations office.

Prospective buyers of your property are also Calculation of the living and usable space important. Some people want to know exactly and ask for the enclosed space (UR) or the gross cubic capacity (BRI), i.e. the volume of your property. You can also find this information from the building regulations office or the architect.

Occasionally sellers do not think about moving out of the Building encumbrance register. The obligations of a property owner under public law are noted here. These include, for example, the location of waste bins or, in the case of extensions or conversions, maintaining a distance from the neighbour.

Duty is a Energy certificate. If the energy certificate is missing at the time of the inspection or if the legal requirements are violated, fines of up to 15,000 euros may be imposed. As a rule, qualified and authorised specialists such as architects, engineers, master craftsmen with appropriate additional training or energy consultants can issue an energy certificate.

You also need a List of all maintenance and modernisation measures and operating costs of the last two years, for example taxes and insurance.

In the case of multi-family houses or condominiums, you will also need declarations of division, minutes of the last owners' meetings and any rental or lease agreements as well as proof of residential and usage rights. You can obtain these documents from the land registry, the property management company or the WEG administrator.
